Product Purchase Agreement
All items, data base and administrations belong to and are given by Biz Styled Stock SRL (“Company” or “we” or “us” or “our”). The expression “You” or “Your” alludes to any client or buyer of said data set (es), product(s) or service(s) (the “Offering”). These Terms and Conditions control and framework how you are permitted to work and access the Company’s Offering. Agreement on Terms of Purchase
Product
Company provides Styled Stock Photography Membership (thus alluded to as the “Product”). Buyer consents to submit to all rules and systems as laid out in this arrangement as a state of their buying. Buyer’s acquisition of the Product incorporates the capacity to enter into contract as well as transactions by electronic methods.
BUYER UNDERSTANDS THAT THEIR BUY FORMS THEIR AGREEMENT AND INTENT TO BE OBLIGED BY THE TERMS OF THIS CONTRACT AND ANY RELATED AGREEMENT
Recurring payments
Upon signing for a recurring membership plan, You hereby approve our access to your financial data stored by our third party financial processing company referenced in this Agreement until your membership is cancelled, as set forth in Your acceptance of the purchase terms upon checkout.
All plans are auto-billed on a recurring basis according to your payment plan. Cancel your current membership any time to prevent future membership payments. Your membership access will be valid until the end of your current plan, but you will not be billed at the end of the term.
Should the payment method you provide be declined in for preceding payments, another attempt will be tried within 5 business days and if there will be no alternate method, your membership will be terminated effective immediately.
Refunds
Taking into consideration the digital nature of our Offering, refunds are not offered and no exceptions will be made because instant access is granted as soon as the membership is activated. Neither are there any refunds or credits for partial months use, upgrade/downgrade refunds, or refunds for months unused with an open account. Avoid renewal charges by cancelling the account before the automatic renewal date.
NO REFUNDS will be given if individuals don’t cancel the subscription before renewal date. The account record will stay active until the finish of the membership term and all pictures downloaded while the participation was active may in any case be utilized.
Termination
Membership may be terminated any time without refunds following the terms of this Purchase Agreement and the Image License: a) ensuing to your break of the terms in this regard; b) subsequent to payment failure of your subscription as related owed to the Company; c) upon becoming insolvent or file, or consent to, a petition in bankruptcy or are adjudicated bankrupt or insolvent or make an assignment for the benefit of creditors or an arrangement pursuant to any law regarding bankruptcy or the rights of creditors or discontinue or dissolve your business or if a receiver is appointed with respect to your business or assets; or (d) if you breach any of the terms of the Photo License.
Charge-backs
Prior to attempting a charge-back with your financial institution, You consent to make every attempt to contact us. In the event of a charge-back attempt, Your license will be cancelled and You expressly agree to lose any bonuses or materials provided to you in exchange for your original purchase of our Offering. We reserve the right to show confirmation of Your access and these Terms and Conditions to the monetary establishment examining the dispute.
Payment Information and Taxes
You must provide accurate, current and full information in relation to monetary transaction interaction with the Company and consent to pay all charges incurred through your credit card, debit card, or other payment method used in connection with a monetary transaction interaction with the Company at the prices in effect when such charges are incurred. You consent to pay any applicable taxes relating to any such monetary transaction interactions. Unless VAT numbers are given at checkout, VAT will be applied to relevant purchases for EU buyers.
Limited License
Photo License
By buying the Product, the buyer agrees to the following Photo License:
Biz Styled Stock membership comes with a non-exclusive limited use license.
Members May:
- Use pictures for individual or commercial use, online and in print.
- Resize, crop or modify picture orientation.
- Overlay the picture with copy, product, brand colors or pdf designs/layouts.
- Use the photos to design opt-ins as long as they are flatted and overlaid with copy or graphics and cannot be removed, and so long as the picture is not a core component of the download.
- Use the picture for multiple commercial/blogs for which the member is the sole owner.
Members May NOT:
- Alter, edit or manipulate the image, or claim its ownership.
- Unless you have purchased an extended license, you may not resell, loan, or offer the image or otherwise allow a third-party to use the image in any way. If you are interested in purchasing a license to resell our images as part of templates, themes, or other projects, please contact us at support@bizstyledstock.co
- Transfer the pictures to clients/customers, even if you have modified the design by adding copy or graphics.
- Transfer membership or login credentials to a third party without previous written consent obtained directly from Biz Styled Stock.
- Use the pictures for social media, websites, or any other online/print mediums for clients/customers or anyone who is not a member of the Biz Styled Stock Membership.
- Use the pictures for eBook covers or physical book covers to be sold on Amazon or such mass dissemination sites without the written approval of Biz Styled Stock.
- Make derivative products from the pictures either for sale or to give away for free.
- Pictures should not be used for any offensive, illegal or pornographic use.
- Use the pictures to promote or sell other stock photography offering, whether for free or paid.
If you violate the Biz Styled Stock terms of use, your membership will be terminated instantly.
Legal Considerations:
- Lorraine Pavel and Biz Styled Stock remain the sole and exclusive owner and holder of the copyright of the images.
- Credit / Attribution is not required, but always appreciated. Remember to use #Bizstyledstock for the Company to see how you use the pictures.
- Members acknowledge that Biz Styled Stock and Lorraine Pavel do not make any representations or assurances of non-infringement and do not make claim to have received releases from any brands, designers, or manufacturers for use of products, registered trademarks, logos or intellectual property portrayed in the images. Members agree that neither Lorraine Pavel nor Biz Styled Stock shall be liable for any damages resulting from the use of any of the photos provided. Biz Styled Stock | Lorraine Pavel shall not be liable for any claims related to, or resulting from, your use of the images, which may or may not have been modified by you, or combined with other content.
Transfer.
Unless you have purchased an extended license, your membership includes a limited, non-transferable, non-exclusive, revocable license for the Offering you have paid for or opted to receive. If you exceed the scope of this license, as determined by a legal authority such as a court of law or the Trademark Trials and Appeals Board, you have committed infringement in a manner that materially harms us, and we have the right to seek damages and/or an injunction to remedy the situation until we are made whole.
Biz Styled Stock Use and Consent
Upon purchase of our Offering, you were given a reasonable notice that these Terms and Conditions existed. By continuing with your purchase of the Offering and further access of the Offering, you implicitly agreed and continue to agree to abide by these Terms and Conditions as well as any disclaimers and privacy disclosures contained in these Terms and Conditions.
You agree you are at least 18 years old or of age in your applicable jurisdiction to access the Offering. Access of our Offering and a related material by a minor is a violation of use, and we reserve the right to terminate your access if such an issue is discovered.
